Terms of Service

Welcome to DinnerSorted! These Terms of Service ("Terms") are a legal agreement between you and Amit Sinha (doing business as DinnerSorted), based at 17 Gallant Rd, Point Cook VIC 3030, Australia ("we", "us", "our"). They govern your access to and use of the DinnerSorted mobile app, website at dinnersorted.vercel.app, and related services (together, the "Service"). Please read them carefully.

Important. By creating an account or using the Service you confirm that you accept these Terms and our Privacy Policy. If you do not agree, please do not use DinnerSorted.

1. Acceptance of Terms

By creating a DinnerSorted account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy. You confirm you are at least 13 years old (or 16 if you live in the European Economic Area). If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.

2. Description of the Service

DinnerSorted is an AI-powered weekly meal-planning service. The Service lets you generate personalised meal plans, swap individual meals, build grocery lists, follow step-by-step cooking instructions, track cooking streaks, view weekly food reports, and (optionally) scan photos of your fridge or pantry to generate plans from ingredients you already have. We may add, modify, or remove features over time.

DinnerSorted is a planning tool, not a substitute for medical advice. Meal plans, recipes, ingredient lists, and grocery suggestions are generated by AI based on the preferences you provide. While we apply strict filters to allergies and dislikes, AI output can be imperfect. Always read every ingredient on a recipe and every label on the food you buy. If you or anyone you cook for has a severe allergy or medical condition, consult a qualified healthcare professional. You — not DinnerSorted — are ultimately responsible for what is served at your table.

5. Free plan

The free plan lets you try DinnerSorted with limited usage (currently a small number of meal plans generated per month, a limited number of meal swaps, and access to the core cooking and grocery-list features). Limits may change from time to time and will be visible inside the app.

6. Pro subscription

DinnerSorted Pro is a paid subscription that unlocks unlimited meal generation, unlimited swaps, the fridge / pantry scanner, weekly food reports, streak freezes, and other premium features described in the app at the time of subscribing.

10. Intellectual property

The DinnerSorted name, logo, app, website, designs, copy, code, recipes generated by our AI system, illustrations, and all other content we create are owned by us (or our licensors) and are protected by Australian and international intellectual-property laws. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own household use. No other rights are granted.

11. User content licence

You retain ownership of any content you submit to DinnerSorted (such as feedback, household-profile data, ratings, photos you choose to scan). By submitting it, you grant us a worldwide, royalty-free, sublicensable licence to use, host, store, reproduce, and display that content solely to provide, secure, and improve the Service. You can revoke this licence by deleting your account.

The Service relies on third-party providers such as OpenAI, PostHog, Stripe, Apple, Google, MongoDB Atlas, Railway, and Vercel (see our Privacy Policy for details). Your use of those third-party services is subject to their own terms, and we are not responsible for their acts or omissions.

13. Disclaimer of warranties

The Service is provided "as is" and "as available".

To the maximum extent permitted by law, DinnerSorted makes no representations and gives no warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free. AI-generated content (recipes, meal plans, grocery lists, ingredient detection) may contain mistakes — use it with judgement.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under Australian Consumer Law (or any equivalent law in your jurisdiction) that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, DinnerSorted (and its owner, employees, contractors, and licensors) is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service — even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising from or relating to the Service in any 12-month period is limited to the greater of (a) the total amount you paid us for the Service in that period, or (b) AUD $100. Some jurisdictions do not allow the limitation of certain damages — in those jurisdictions our liability is limited to the smallest amount permitted by law.

15. Indemnity

You agree to defend, indemnify, and hold harmless DinnerSorted and its owner from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Service.

16. Termination

You may terminate these Terms at any time by deleting your account (email aasinha@gmail.com). We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, your use poses a risk to us or other users, or we are required to do so by law. Sections that by their nature should survive termination (including sections 10, 13, 14, 15, and 18) will survive.

17. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you in the app or by email at least 14 days before the changes take effect, and we will update the "Effective date" above. Your continued use of the Service after the changes take effect means you accept the updated Terms. If you do not accept the changes, you must stop using the Service.

18. Governing law and jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia, without regard to its conflict-of-laws rules. You and DinnerSorted agree to submit to the exclusive jurisdiction of the courts of Victoria, Australia for any dispute arising out of or relating to these Terms or the Service — unless you are a consumer who, under the law of your country of residence, is entitled to bring or defend an action in your local courts. Nothing in this clause limits your statutory rights.
